1. Description of Service

Our Platform provides Software-as-a-Service (SaaS) tools that enable users to clone, replicate, archive, or transform website structures, designs, and content for legitimate web development, testing, backup, and migration purposes.

The Service acts strictly as an automated processing intermediary and host. PT Tibagede Solusindo Indonesia does not independently verify, review, or edit the content, websites, or data that you choose to clone or process using our platform.

2. Eligibility & Account Registration

1. Eligibility: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use this Service. By creating an account, you represent and warrant that you have the legal capacity to enter into a binding contract.

2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Accurate Information: You agree to provide accurate, current, and complete registration details.

3. Mandatory User Representations & Ownership Warranties

Sole Responsibility Notice: Because the Platform enables the replication of web content, you bear sole legal responsibility for all cloning requests and output content.

By requesting, initiating, or executing any website cloning job on our Platform, you explicitly represent and warrant that:

Rights and Permissions: You own the target website, hold a valid license, or have obtained explicit, verifiable written permission from the legal copyright and trademark owner.
Non-Infringement: Your use of the Service does not infringe upon third-party intellectual property, copyright, trademark, or trade secret rights.
Legal Compliance: Your activities comply with all applicable local, national, and international laws (including consumer protection and data privacy).
Public Accessibility: You will not attempt to clone resources behind login portals, paywalls, or non-public authentication barriers without explicit authorization.

4. Acceptable Use & Prohibited Conduct

Your access to and use of the Service is subject to strict compliance with our Acceptable Use Policy (AUP). Explicitly prohibited activities include:

Phishing & Brand Impersonation: Deceptive practices, credential harvesting, or brand spoofing.
Intellectual Property Theft: Unauthorized copying or distribution of proprietary software or copyrighted works.
Malicious Code: Distributing malware, ransomware, spyware, or exploit scripts.
Privacy Violations: Unlawfully scraping personal data without a lawful processing basis.

5. Intellectual Property Rights

1. Platform Property: All rights, title, and interest in and to the Platform (software code, branding, interfaces) remain the exclusive property of PT Tibagede Solusindo Indonesia.

2. User Content: We claim no legal ownership over the target website content you clone or process.

3. Limited Technical License: You grant us a non-exclusive, worldwide license to host and process materials solely to deliver the Service to you.

6. Infringement & Takedown Policy (DMCA / IP Claims)

If you believe content hosted or cloned via our Service infringes upon your copyright or trademark, submit a written notice to: info@tibagede.site

Valid notices must include physical/electronic signature, identification of infringed work, exact URL/location, contact details, and a statement of good faith belief.

7. Subscriptions, Fees & Payments

Fees paid for subscriptions or service credits are non-refundable except as required by applicable law. Accounts terminated for Terms or AUP violations forfeit remaining balances.

8. Limitation of Liability & Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PT TIBAGEDE SOLUSINDO INDONESIA DISCLAIMS ALL WARRANTIES AND SHALL NOT BE LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. Exclusive jurisdiction lies with the competent courts of Indonesia.
